Another Smart Move? Tuju Moves to Court Seeking Protection from Arrest While Hospitalised

Former Cabinet Secretary Raphael Tuju has moved to the High Court with an urgent application seeking to stop his arrest and detention as he continues receiving treatment in hospital.

In the application, Tuju is asking the court to grant him anticipatory bail and to order the removal of police officers stationed at his bedside.

Through his legal team, Tuju argues that his health condition remains delicate and requires a calm and stable environment for recovery.

He says the presence of police officers in his hospital room has caused distress and may interfere with his treatment.

According to the court documents, his doctors have recommended that he be allowed to recover without unnecessary pressure or disturbance.

Tuju is also seeking protection from what he describes as a possible arrest once he is discharged from hospital.

His lawyers say there are strong indications that authorities intend to take him into custody, a move they believe could further worsen his condition.

They argue that anticipatory bail is necessary to safeguard his rights and ensure he continues to receive proper medical care.

In the application, Tuju maintains that he is ready to cooperate with investigators if required.

However, he insists that any engagement with law enforcement should take into account his current health status.

He says he is not trying to avoid the legal process but is simply asking for fair treatment and respect for his well-being.

The request to remove police officers from his hospital room is one of the key issues raised in the case.

Tuju’s legal team says their presence creates an atmosphere of fear and anxiety, which is not suitable for a patient in recovery.

They have urged the court to consider ordering the officers to keep a reasonable distance while still allowing the law to take its course.

This latest move comes after a series of events that have placed Tuju under intense public attention.

His health concerns and ongoing legal matters have sparked debate about how individuals in such situations should be treated, especially when they require medical care.

Legal experts say anticipatory bail is often granted in cases where there is a real fear of arrest, particularly when the applicant can show that their rights may be at risk.

They note that the court will have to balance Tuju’s personal circumstances with the need to uphold the law.
