Waititu Seeks Review of Bail Terms Over Bank Guarantee Challenges

Former Ferdinand Waititu has moved to court seeking a review of his bail conditions, asking for a reduction of the bail amount or permission to secure his release using property such as land or motor vehicles.

Through his legal team, Waititu has proposed that the bail amount be reduced to Ksh.20 million. 

Alternatively, he wants the court to allow him to provide property as security instead of the bank guarantee that was previously ordered as part of his release conditions.

His lawyers told the court that their client has been unable to secure the required bank guarantee despite making efforts to comply with the earlier ruling.

The defence team explained that it has now been seven months since the court issued the bail terms.

During this period, they argued, Waititu has faced financial and procedural challenges that have made it difficult for him to meet the bank guarantee requirement.

According to his lawyers, the strict conditions have limited his ability to fully benefit from the bail granted by the court.

Waititu’s legal representatives further argued that since he was already admitted to bail, the court should now focus on reviewing whether he has been complying with court requirements.

They told the court that the main issue should be whether their client has been attending court sessions as ordered and whether the bail terms remain fair under the current circumstances.

The defence maintained that Waititu has consistently honoured all court summons and has shown willingness to cooperate with the legal process.

They added that there has been no indication that he intends to avoid trial or interfere with the case in any way.

His lawyers insisted that he is not a flight risk and therefore deserves reasonable bail conditions that he can meet without unnecessary difficulty.

The former governor, who once led Kiambu County, has been facing legal challenges that led to his arrest and subsequent bail ruling.

His case has continued to attract public attention due to his past political influence and the nature of the charges he faces.

Supporters have argued that he deserves fair treatment under the law, while critics insist that legal processes must be allowed to proceed without interference.

Legal experts note that courts often review bail terms when accused persons demonstrate genuine challenges in meeting the set conditions.

However, they also point out that judges must carefully balance the rights of the accused with the need to ensure that justice is served and that individuals attend court as required.
