Inside Murkomen’s Surprise Decision That Changes Everything for NGOs

Interior Cabinet Secretary Kipchumba Murkomen has extended the transition period for non-governmental organisations seeking registration under the Public Benefits Organizations Act by one year.

The extension, which takes effect from May 14, 2026, is expected to give organisations more time to comply with the requirements of the new legal framework governing their operations in the country.

According to the Interior Ministry, the decision follows consultations aimed at ensuring a smooth transition from the previous regulatory system to the current law, which seeks to enhance accountability, coordination, and transparency within the sector.

The Public Benefits Organizations Act introduces a structured framework for the registration, regulation, and monitoring of non-governmental organisations, charities, and other public benefit entities operating in Kenya.

Officials say the additional time will allow organisations that are yet to complete the registration process to regularise their status without disruption to their ongoing programmes and services.

Many NGOs play a critical role in delivering services in areas such as health, education, humanitarian support, community development, and human rights advocacy, particularly in vulnerable and marginalised communities across the country.

The government has maintained that the reforms under the new law are not intended to restrict the operations of civil society organisations, but rather to strengthen governance and ensure that resources are used effectively and in line with national priorities.

CS Murkomen said the extension was necessary to accommodate stakeholders who had expressed concerns over readiness and capacity to fully comply within the original timeline.

He noted that the transition process requires adequate preparation, including alignment of organisational structures, reporting systems, and compliance frameworks with the new legal requirements.

The Ministry of Interior has also encouraged organisations to take advantage of the extended period to complete pending documentation and engage with the relevant regulatory authorities for guidance.

At the same time, the government has reiterated its commitment to working closely with the NGO sector to ensure that the implementation of the Act is smooth and inclusive.
