Court Orders Arrest of Two Businessmen Over Alleged Ksh150 Million Westlands Property Fraud

Court has issued a warrant of arrest against two businessmen, Abdisalan Adan Hussein and John Kigomo Mwaura, in connection with an alleged conspiracy to defraud two women of a maisonette in Westlands, Nairobi, valued at Ksh150 million.

According to the charge sheet, the two are accused of conspiring to defraud Sabahatt Shokatali Habib and Sadaff Shokatali Habib on April 29, 2019. 

The prosecution alleges that the suspects fraudulently registered a lease document for the parcel of land on which the maisonette stands, with the intention of unlawfully taking ownership of the property.

The case, which has been pending before the Milimani Law Courts, took a new turn after the accused persons failed to appear in court for plea taking.

The two businessmen had been scheduled to take their plea on Thursday, April 16, 2026, after being summoned by the court. However, they did not present themselves as required.

Milimani Principal Magistrate Geoffrey Onsarigo had directed the two to appear in court on Friday, April 17, 2026, for plea taking.

Despite the directive, the suspects once again failed to show up, prompting the court to take further action.

Following their absence, the magistrate issued a warrant of arrest to compel their attendance in court.

The order now authorises law enforcement agencies to apprehend the two and present them before the court to answer to the charges.

The prosecution maintains that the alleged actions by the two businessmen amount to a calculated scheme to deprive the complainants of their property through fraudulent means.

The court heard that the disputed lease registration forms the basis of the alleged conspiracy, raising concerns over the integrity of property transactions.

The complainants, Sabahatt Shokatali Habib and Sadaff Shokatali Habib, are said to have been the rightful parties to the property before the alleged fraudulent dealings took place.

The case highlights growing concerns over land and property fraud in Nairobi, particularly involving high-value real estate in prime areas such as Westlands.
