High Court Dismisses Petition Challenging Senior Counsel Status for 54 Lawyers

The High Court of Kenya has dismissed a case that sought to challenge the conferment of Senior Counsel status to 54 advocates, ruling that the petition did not follow the required legal procedures.

In a decision delivered by Wilfrida Aburili, the court struck out the petition after finding that the case had not met the necessary standards for it to be properly heard and determined.

The petition had questioned the process used to award the prestigious Senior Counsel title to a group of lawyers, among them prominent advocates Katwa Kigen and Nelson Havi.

Senior Counsel is one of the highest professional recognitions that can be given to an advocate in Kenya. 

The title is awarded to lawyers who have demonstrated outstanding contribution to the legal profession through their work, experience, and commitment to justice.

The recognition is conferred through a formal process overseen by the Judicial Service Commission and the Law Society of Kenya.

Those who filed the petition had argued that the process used to select the 54 lawyers was flawed and should be reviewed by the court. 

They sought orders to block or question the conferment of the Senior Counsel titles until the issues they raised were addressed.

However, Justice Aburili ruled that the petition itself had procedural weaknesses that made it difficult for the court to properly consider the claims raised.

In her ruling, the judge stated that the case had not been filed in accordance with the legal requirements that guide such constitutional petitions. 

Because of this, the court concluded that the matter could not proceed.

Legal experts say that when a case is struck out due to failure to follow due process, it means the court has not examined the substance of the arguments but has instead focused on the technical requirements that must be met when filing a case.

The decision therefore leaves intact the conferment of the Senior Counsel titles to the 54 advocates who had been recognized through the earlier process.

Observers within the legal community say the ruling is significant because it highlights the importance of following proper legal procedures when bringing disputes before the court.

They also note that the Senior Counsel title remains a highly respected distinction within the Kenyan legal profession, often given to advocates who have handled major cases or contributed significantly to the development of law and justice.
